Further to our announcements dated 28 November 2024 and 22 May 2025, Azam Jaya Berhad (“Azam Jaya” or “the Company”) wishes to provide an update on the material litigation involving Pembinaan AJ (as Plaintiff) and MBB (as Defendant).
On 11 September 2025, the Court of Appeal of Malaysia allowed the Company’s appeal and set aside the High Court’s decision dated 16 August 2022 in Civil Suit No. BKI-22NCvC-2/1-2020. The High Court had previously dismissed the Company’s claim against MBB.
The Court of Appeal has now ruled in favour of Azam Jaya, awarding the Company a total sum of RM4,597,062.00 as contract proceeds for works completed under the Pan Borneo Highway (Package 6) project. Additionally, the Court awarded RM30,000.00 in costs, applicable both at the Court of Appeal and High Court levels.
Subsequently, on 11 October 2025, MBB filed a Motion with the Federal Court seeking leave to appeal the Court of Appeal’s decision. This Motion is currently pending a hearing date.
The Company will make further announcements as and when there are material developments on this matter.
